Legal Question in Family Law in Virginia
My ex-husband and I have joint legal/physical custody in the state of Virginia. I cannot afford an attorney, however he has violated our custody agreement by unenrolling our daughter from her current school (daycare) and enrolling her in one we did not jointly decide on. I have expressed my concerns about his decisions however he has chosen to ignore them and anything I have to say. Where can I find the correct forms to file and if I would need to file a show cause motion or a motion for contempt?
1 Answer from Attorneys
Assuming the issue of custody is within the jurisdiction of a circuit court,
there are no such forms and one proceeding here will normally
need to be represented by counsel.
However, if the matter has been transferred from the circuit to the J&DR;court
or was originally filed there, then you can go to the clerk's office and they
will have the forms you need to file your Rule to Show Cause
without the aid of counsel.
