Legal Question in Family Law in Virginia

Ex-Wife wants my surname back

My ex-wife was re-married, now she is getting a divorce and wants to take my last name back. Is there any thing I can do legally to prevent her. I'm being told by a friend that she has to go to court to petition this and I can go and protest it. Do I have a leg to stand on?

Re: Ex-Wife wants my surname back

As long as the name change is not to mislead or to defraud creditors or for other illegal purposes, the court will likely grant your former wife's petition to change her name back to the one she had prior to her most recent marriage.

In America you can usually call yourself pretty much what you want as long as the motive to make it official through a court, as aforementioned, doesn't involve some illegal objective.
