I just recieved a call from my daughters mother stating that she is homeless and has custody of my one year old daughter. I am currently married with two son's living with my wife and I and would liek to know how i can file for an emergency hearing to get even temporary custody of my daughter being that her mother is unstable at this point. We haev a virginia order and I like in colorado (military) and am unsure where her mother is living being that she moves repeatedly without notifying myself or the courts. I have no intention of getying and keeping my daughter away from her mother I am just vey worried about her living conditions as of right now. I have been sending her money through an allotment and direct transfers into my daugters account that I have proof of althought there is currently no child support order. I have no problem supporting her either way but would like her to be in a more stable enviroment with her brothers.

Before you can initiate any action for an emergency hearing on the matter of temporary custody, you must have a specific and verified address where the mother can be served with papers.
If the mother happens to be discovered living with the child in a state other than Virginia, then a new order would likely have to be established in that particular state regarding the matters of custody and any related issues.
