Legal Question in Family Law in Virginia

Unmarried mother has full time

custody of infant to which the

unmarried ''father'' has seen twice

since birth. He is now incarcerated

for ''rape'' and once out will be on a

10 year probation and serving

another 8 years probation on a felony

grand theft prior to meeting him,

yeah I know what a catch. Will he be

able to get visitation rights if he

pursues them in court?
