Legal Question in Family Law in Virginia

My father passed away 2 years ago. My oldest brothers name was on his checking account to pay his bills. When he passed my brother kept $10,000 that was left remaining. Does he have a right to keep this money or should it have been turned over to the estate? I live Va. My email address is [email protected]. If this is a free advice site for attorneys, I greatly appreciate your advice. I cannot afford an attorney at this moment. Thank you, Donna

If this brother was on the checking account as a joint holder of this account with right of survivorship, he became the sole owner of the account and the funds therein when your father passed.

However, if his status with respect to this account was something different,

then he may have been obligated to turn over the funds in this

account to your father's estate.

You may wish to arrange for a consultation with a local attorney in your

area who handles probate matters for further advice on this matter.
