You may have to go to court to have the power of attorney declared invalid due to your father's incompetency. If you wish to do this, you will almost certainly need to hire an attorney as you probably cannot do this on your own. The court may be able to order that your attorney fees be paid out of your father's funds. If you contact the Virginia Lawyer Referral Service at (800) 552-7977, they can refer you to a lawyer who will charge you only $35 for a half-hour consultation.
