Legal Question in Family Law in Virginia

My father has had temporary custody of my sisters children for over a year but has taken care of them since they were born due to the mothers lack of interest in the children and her drug history. She signed them over to my father. She is now petitioning for custody back. Due to no recent change in her life (there is proof she has used drugs in the last month), could it be possible my father would keep custody? The children are almost 4 and the other is 2.
