Legal Question in Family Law in Virginia

Father is very uninvolved in kids' lives. Stated in Feb '10 that he wanted to terminate his parental rights. We divorced in Sept '10 and I took my maiden name. Can I change the children's names as well?

Yes, but only by filing a Petition for Name Change for a Minor Child with

your local circuit court (serving the father with notice and opportunity to contest)

and receving an order from the court for the change.
