Legal Question in Family Law in Virginia

If the fathers name is not on the birth certificate what rights in Virginia does he have. The reason for free the mother is in court now and the so call father has two DUIs and many other things but he always walks away a free person. The little girl hates to be with him this has been going on for 5 1/2 years.The mother has run out of money for a new lawyer.

If the father has already been to court regarding his rights/responsibilites for this child, whether his name is on the child's birth certificate is very likely largely irrelevant.
