Legal Question in Family Law in Virginia

with out fathers consent

What are my rights if the mother of my child took the child and moved out of state without my consent. We were never married, child bares my last name on birth certificate. And there are no leagal custody papers at this time. We have agreed on child support and monthly visitation but she continues to threaten my visitation w/ any minor dispute.

Re: with out fathers consent

If your child has been a resident of the

Commonwealth within the six months preceding

the child's removal from the state, you could file for custody in your local Juvenile & Domestic

Relations District Court.

You could also retain an attorney to represent

you in the other state to get established in a

court order your rights having to do with visitation and your obligation to pay child

support spelled out, exactly, to whom and

how often.
