Fight over custody

My ex and I have separate for over two years, he won't sign divorce papers. I have started dating someone serious and introduced my kids to him. It's been very limited contact. My ex is now sueing me for custody based on my dating and intentions to move (not moving their schools). We currently have joint custody with split physical custody. I have countered due to lack of structure, living conditions, and his recent DWI. Do I have a good chance at winning physical custody or does he?

Who could reliably say based upon these paltry facts? Better see an attorney who knows at least something about Virginia matrimonial law.
