Legal Question in Family Law in Virginia

How do I find out my grandaughters legal name? My son died 13 days after her birth, serving his country in Iraq. I've yet to see any documentation from her mother with my granddaughters real name on it. My son was not married to the mother of his child, the mother had told him she was seperated from her husband, but she was actually married. The state the mother resides in is Ohio/Michigan right on the border.

Under the facts which you've described, the child whom you claim is your granddaughter most likely has either the surname(last name) of the mother's husband or her maiden name if she had reverted to that by the time this child was born.

And, since there are no post-mortem actions normally available to establish paternity in behalf of a putative father who has become deceased (such as your son), whatever name your granddaughter currently has is not likely to change any time soon.
