Is it fraud and does he have a real case? My husband move out of the house and left me and my then six years old daughter. I needed a cell phone for emergency. I had one but my husband ran the bill up to almost $500 and refuse to pay. In return I got a cell phone in his name. After I paid the deposit and got the phone, he found out about it. He agreed to let me keep the phone and notified the phone company to authorize me excess to the account. For five years I had this account now my ex-husband want the account and the credit but he doesnt want to pay the final bill of $137.00. He feels even though he never paid mines and it was in the divorce decree that he does I should pay the bill. He said the phone company wants to charge me with fraud. He though they had to get authorization from him to let me have acess to the account. Can I be charge with fraud even though I have permission to use the account.

No, and if the SOB refuses to pay the $137.00, consider suing him in small claims court.
