Gifts as separate marital property in a divorce settlement.

I gave my wife a car for her birthday during our marriage. She believes it should not be part of our marital assets since I bought it for her on her birthday as a gift, but I used marital assets to pay for it. Can she do this?

Re: Gifts as separate marital property in a divorce settlement.

Gifts made by one spouse to the other during the course of the marriage are not normally considered marital property even though marital assets might have been to effect their purchase.
