Legal Question in Family Law in Virginia

My girlfriend has a child that is with her sister in VA. She signed temp custody to them several months ago. Now she wants the child back. They are trying to keep the child. Do they have any grounds? If I was to marry her and sign legal adoption papers in Florida where we live, will that make any difference?

All your girlfriend needs to do is to go to Virginia and file for the custody of

her children in the Juvenile & Domestic Relations District Court of the city or county where they are currently being held by this sister.

Merely by filing for custody and having the Sheriff's deputy come and serve her with notice of the lawsuit may be suffcient inducement for this sister to return these children to their rightful custodian, i.e., their mother.
