Legal Question in Family Law in Virginia

My girlfriend is stuck in a marriage she doesn�t want to be in due to Philippine law stating "divorce is illegal". She went back to the Philippines last July with her husband and gave birth to our son in December. Just recently in July 2011, I have verified DNA proof he is ours. Since she is living in the Philippines, i have never seen my son in person. Where do I start to help her get out of her trapped relationship and get her and our son back to the states ASAP? All parties are US citizens. However the husband doesn�t know the child isn�t his, despite my pleas for her to tell him the truth, she feels that she cannot due to Philippine law. I am willing and able to take on all responsibilities as a father to our son and she knows that. I don�t want her to get into trouble with the legal system in the Philippine�s, so I�m trying to find the best way to go about this delicate issue.

As a U.S. citizen your girlfriend could return to this country anytime and initiate

divorce proceedings against her husband in the Philippines once she has met

the requirements for divorce of the particular state in which she resides.
