Grandchildren Visitation
Hello,
My wife and I are trying to get visitation for our two grandchildren. It�s a bit complicated, but my wife�s daughter (my stepdaughter) gave up custody of them over a year ago to one of the children�s other grandmother.
She has proceeded to be very difficult to deal with, our daughter then sided with her against us saying that we would not be able to see them anymore. Our daughter had these kids all over Virginia/New York the first few years of their lives, anywhere but in a stable home.
Darlene (the other grandmother) has used these children as pawns in an effort to be in total control over everyone. We just want to see our grandchildren, my wife did have every other weekend visitation but when she was in New York with me for an extended period (where I�m from) it was taken away from her by the court because she was not present.
Were not sure if we can pursue this in court or not. Please help.

Yes, if your grandchildren are currently residents of the Commonwealth, you should be able to petition
in J&DR court as grandparents recognized under Va. Code Sec. 20-124.1 as persons with a legitimate interest in obtaining visitation with their grandchildren.
