Grandparent visitation

Does my mother have the right to go to court for visitation of my daughter. She has never been denied access to come to my house to see her. We do not take her over to her grandmothers because she smokes heavily. Does the parent not have the decision where the child goes?

Grandparents , under Virginia law, have the right to petition for visitation with their grandchild(ren). It's up to the court to decide whether an actual order should be entered outlining the specifics of the visitation.

If your mother files for visitation and you oppose

her taking your daughter into environments where she (your daughter) may be exposed to heavy smoking, then you should plan to attend the hearing and explain the basis for your opposition to the court.
