grandparents rights

my son has a 17 mos old boy,he is no longer with the baby''s mother as of last month now she plans to move out of state.what rights do i have that will ensure that my grandson can remain in my life. even if she stays in town and my son and her never speak again can i take his place as guardian

Not too likely(your being appointed guardian), but since Virginia grandparents are recognized as "persons with a legitimate interest" in visitation rights with respect to their grandchildren, you could certainly petition the court to establish your right of visitation

with this particular grandchild.
