Grandparents Rights
My son has 2 young girls (aged 4-5)with a cohabiting female. The family was living in my home in VA. Due to problems in the relationship, the mother has decided to return with the girls to her native OK. She just left, giving no notice to us or the girls father. Do we have any legal grounds to compel her to return the girls to their/our home state?

If the children were residents of the Commonwealth for at least six months, then Virginia courts would have jurisdiction to determine matters involving custody and visitation, but if the children and mother have already removed themselves to the state of Oaklahoma, in the absence of any valid Virginia court order, it would now likely be quite difficult to legally compel their return to the Commonwealth.
