Grandparents Rights

What visitations rights do grandparents have. Is J & D court the best bet or DSS first . My son is on his overseas deployment and cannot file with the court. The mother is currently living with another man in substandard housing. We feel that our granddaughter is not being properly cared for and would like to know which solution you suggest.

You could certainly file for visitation rights in the J&DR Court in the city or county where the child currently resides, citing Virginia Code Sec. 20-124.1 which recognizes grandparents(among others) as persons with legitimate interests in securing visitation rights with their grandchildren.
