How to Handle Potential Child Support Issue
My husband has a child from a previous relationship. The child's mother is not cooperative. Although we have an agreed-upon child support arrangement, it is not court-documented or court-enforced. We are under the constant threat of being taken to court because of vengefulness and spite. Also, there is no regular visitation because of the uncomfortable situation with the mother. It boils down to emotional blackmail. In any case I have encourraged him to set up a regular visitation schedule and ignore her threats. My questions are: Does VA law consider both salaries of a married couple, along with the child's mother's salary when computing support? To minimize the threats, do you suggest we initiate court proceedings for support and visitation? Should we document our current informal arrangement and have it notarized? Does she have any rights to threaten action if my husband involves me in the child's life? At what age can we request the child visit the father's home without the mother? I'd appreciate any advice you can give. We are being held over a barrel.
