Harassing Phone Calls from X

My husbands X wife called 15 times and left harassing/threatning messages on our answering machine. Can we use these to help us when we go back to court about our reduction in child support and to get custody? Thanks

The first advice is to consult an experienced divorce and domestic law counsel in your neighborhood. Secondly, consult you local telephone customer service as to how to establish a record, caller I.D. service, etc. You probably should, as a tatic, record some of those statements but you may NOT use them as evidence. However, such recordings may be useful in other ways even though they must be kept VERY confidential.

You(or your attorney) would be able to use these messages only if the court deemed them to be relevant evidence and therefore admissible in the matter(s) under consideration at the hearing.

It is unlikely that the court would consider them as such.
