Legal Question in Family Law in Virginia
Hi,
My child and I have been dealing with an abusive mother for years. My child has been in therapy for one year with no end in sight. She never wants to see her mother and has expressed her wish that she die for years now. We have a custody agreement that has completely failed to protect my daughter, and the legal hurdles for changing this abusive precedent are enormous. Is it difficult to have the mother submit to a psychological evaluation? And what if I were to relocate to another state with my daughter? Thank you in advance for your help.

The situation you've described appears full of conclusions with few relevant facts, however, to support them, including any that would justify a judge ordering
the subject child's mother to undergo a psychological evaluation.
Assuming that your custody order carries a provision that requires you to
give advance notice to the court as well as to the mother of at least 30 days of any intended move on your part, it would seem probable that the mother would
likely request a hearing on the matter to oppose it.
