Legal Question in Family Law in Virginia
Is there any way my ex husband (who is not the bio father) can adopt my daughter (with me remaining the mother and her still residing with me)? She is 7.5 years old and her biological father hasn't attempted to meet her and my current husband won't adopt her because we are on the rocks.

I suppose that a former stepparent could possibly be considered as an appropriate prospective adoptive parent but more information would appear to be necessary in order to make such a determination for this particular situation.
For one thing, if your daughter was born during your marriage to this ex husband, he would already be considered legally as her father.
