Legal Question in Family Law in Virginia

My husband has been in jail since March 19th of last year. He was charged with several counts of aggravated sexual battery and sodomy of a minor under 13. He has not yet been found guilty or innocent. We have two daughters one of which he has never even met. I want to file for a divorce. What do I need to have a divorce granted?
