Legal Question in Family Law in Virginia
My husband and I have been raising our grandson since he was a baby. He is now 12 years old. My husband died approximately five years ago and I've been raising my grandson by myself. We have never received any child support from the father or mother. There was a divorce decree stating the father was to pay support but he left the state of north carolina and I finally adopted my grandson two years ago. I was wondering if there is a chance of collecting back child support up to the time of the adoption. His father now lives in Virginia and has some type of government job. The mother has remarried and lives in North Carolina. She sees her son but only gives birthday and christmas presents. The father doesn't do a thing. Can you help

Yes, the arrearages accrued on the part of the father up until the time that his parental rights were terminated in the adoption proceeding could still be enforceable. And, if you're interested in pursuing these arrearages, I would recommend that you contact your nearest DCSE(Division of Child Support Enforcement) district office to arrange for an appointment to come in to discuss the matter.
