Legal Question in Family Law in Virginia
My husband and I have been separated for three months. We tried counseling, but he didnt think much of being told anything was his fault so that ended quickly. We agree on pretty much everything for separation, mostly because I am not asking for any support for our son (2yrs old). We have already settled the debt, property and custody. I realize an attorney would be the best way, but neither of us can afford it and with agreeing on everything I dont see a need. Do we need to get the agreement notarized ? Do I file it with the court ? which division ?

If you're referring to a PSA(Property Settlement Agreement), the answer is, yes, both parties to the agreement should appear before a notary to witness their respective signatures on the document. The PSA does not need to be filed with the court until divorce proceedings are initiated.
The fact that the agreement does not include an amount of child support for the minor child
is a mistake(in my opinion).
