Legal Question in Family Law in Virginia

me and my husband are seperated we have a joint home equity loan of $42k that we tool out together. the house is only in his name and he has not been paying the loan. I have talked with the finance company and told them what was going on. I live in virginia and would like to know what I can do to make sure that this finance company does not try and garnish my pay check to get the money owed

If you're on the note for the home equity loan, then you're jointly responsible with

your husband for paying it, and therefore you could be sued by the company for the arrearages that have accrued under this loan(if the loan company doesn't decide to foreclose first on the subject property).

In any event, this finance company would first have to obtain a valid

court judgment against you before it could garnish your wages.
