Legal Question in Family Law in Virginia

my husband and i have been seperated since 2009, we will be filing for our divorce in the state of virginia.. will we still have to wait that 1 year period or will it already be filed as a finalized divorce?

If you've already been separated, living separate and apart continuously and without cohabitation for at least 12 or more months immediately preceding the filing of your divorce, your divorce can now be filed in

the appropriate Virginia circuit court at any time and without any further waiting(assuming that you meet the other statutory requirements).
