Legal Question in Family Law in Virginia
My husband had a terrible car accident in December of 2008. He had to have 2 discs removed from his neck and a fusion done in January and got the ok earlier this week to go back to work. Workers Comp finally agreed to pay last month. He and I sold our home and separated at the end of January. I would like to know if I have a claim to any of the money he will collect from a CIVIL suit that will hopefully settle next year. I do not have an attorney and neither of us has filed anything towards divorce at this time.

No, it is unlikely that you would be considered entitled under the circumstances described to share in any award of damages that your husband might receive at some future time from a lawsuit that has yet to be filed (in my opinion).
