Legal Question in Family Law in Virginia

When my husband was 13 a 17 year old girl raped him. Today we got papers in the mail saying that she his taking him to court to establish the paternity of her now 13 year old daughter. My husband was raped by this woman, this took place in the state of Virginia. Is it legal for my husband to deny to take this paternity test and get a lawyer to press charges on her for rape?
