income taxes

It states in my divorce decree that if my ex does not work then I claim both children, for two years now she has not worked but still claimed 1. My question is, is it worth it to refile my taxes or do I have to go back to court? Also chose not to see my kids it's been 3 years what are the chances of the judge changing the order to her claiming both?

You should be able to file amended returns for the last two years in order to make an adjustment

in your taxes by taking the extra deduction without returning to court.

If your ex-wife has already illegally claimed the deduction, that's her problem---not yours.
