Legal Question in Family Law in Virginia
infidelity
If your spouse has an affair, admits it and it is verified by the ''other'' person, you are pretty much in the drivers seat should you decide to go to court aren't you. I am referring to custody of a minor. The only thing they have on you is that you have viewed adult web sites from time to time.

Re: infidelity
No, the other spouse's infidelity(whether alleged or verified) is likely to be regarded by a court as an issue of little import with respect to deciding a custody matter.

Re: infidelity
Unfortunately the adultery will not come into play with the custody issue. It will be important, however, when determing how divide marital property and possibly spousal support.
