Only if s/he wants to risk being charged with adultery in the ensuing divorce proceeding.

Adultry is an issue. If your divorce is not final - then you are still married and it is wise not to sleep over lover's home. Whether it will really impact your case or not is fact specific and depends on the judge for the most part. Atleast, that is my opinion.
