Insurance claim and divorce

My wife and I have a Insurance claim pending against an Insurance co for car accident caused by their insured. My wife has now deserted me and I do not know, where she is living as she not communicated with me. have filed for divorce.

How do I handle the Insurance claim a) Can I settle just for my part b) Can I sign of behalf on my wife as we are still married under the laws in USA and India.

c)Do I have to advise the Insurance company of the current situation

Please advise.

Yes, you should be able to settle just for your part. Given the particular circumstance which you're now apparently facing with your spouse, it would probably not be advisable for you to attempt to settle your wife's claim.

And, yes, of course, you should advise the insurance company of the fact that you do not know the current whereabouts of your wife but that you are now prepared to settle your share of the claim.
