Do we have to invite her into the courtroom?

My 5 yr. old gradchild has lived with me nearly since birth. My son has physical custody. Biological mother lost all visitation in 2001 for not complying with court orders. I would like partial custody for schooling purposes. My son says fine but I have been lead to believe that the mother must be asked back into court for her permission. Can she sign papers in a lawyers office so that we don't have to take her back into the courtroom?

The court having jurisdiction over the custody matter should be able to provide the answer to this question(or one of the attorneys involved, assuming that there's at least one.)
