Legal Question in Family Law in Virginia

Jail for non-payment of support

I am being taken to court for non-payment of child support. I was paying until I lost my job. My income has lowered considerably and I want to know if I can be jailed for non-payment due to lack of employment. I also want to know if my child support can be lowered due to my lower income.

Re: Jail for non-payment of support

If you're found guilty of contempt of court, you could be jailed. The judge will want to know why you failed to notify the court regarding your situation and request the appropriate relief.

Whether or not your support obligation can be lowered will be up to the judge after she or he has heard all the evidence and the arguments for or against from the parties.
