Legal Question in Family Law in Virginia

I have joint custody of my grandchildren, their father is deceased and their mother lives in a different state. I tried to have them added to my health insurance and was told that I neede either lrgal guardianship or a Qualified child medical order of support. How do I get this. I have had the children for over 2 years and do not receive any support from their mother or the state, we pay everything for them. We do not even ask for reduced lunches. I need some help. It is breaking us trying to supply medical care for these children. Can you give me any advice?

Try starting with your local office of the Division of Child Support Enforcement.

If you already have legal custody, you might try filing an application in your local circuit court for appointment as guardian of the child. A lawyer should be able to help you with this for a quite reasonable fee.

Good luck.

Modify the custody and seek support from the living parent. Also check with the DSE as listed above. Good luck. Attorney Sheryl Shane. Web: www.sherylshanelaw.com.
