Legal Question in Family Law in Virginia

I had joint custody of my son. the other parent recently passed. should I go to the courts and file for full custody?

What for? With the passing of the other parent the law now recognizes that

full custody of your son is now invested in you and that there is no need for you to file anything with the court to establish what the law already recognizes.
