Legal Question in Family Law in Virginia

joint custody-noncustodial parent moving out of state

I have joint custody, i am the custodial parent(residential custody). My X is suppose to get the girls for the summer & has informed the girls (not me) she will be moving two states away. Can she take the children out of state w/out my permission? If so, how can i get an address & phone #, when she won't give it to me? She is also several thousands of dollars behind, won't keep a job to pay child support. What do I do? Her children & shes doesn't want the responsibility.

Re: joint custody-noncustodial parent moving out of state

What does your parenting plan say regarding the removal of the children from the state by the non-custodial parent? If this issue is not addressed or addressed only in an ambiguous manner, a motion to clarify the plan should be filed with

the appropriate court and a hearing scheduled to resolve this issue.

The motion could also include a request for a Show Cause on the issue of the back child support which could also be addressed at the same hearing.
