Legal Question in Family Law in Virginia

Joint obligations after divorce

I and my wife purchased a single-family home in 1964. We were divorced in 1995. She abandoned me. In the divorce decree, she relinquished all rights to the home. I plan to repair the home and sell it. I paid for the house alone and pay the taxes. She has not contributed, ever, to upkeep, payments or anything pertaining to the house. If I sell the house, she wants half of the settlement.

Do I have to share the settlement with her?

Re: Joint obligations after divorce

Unless it was stated in a settlement agreement or court order that the proceeds of the house are split, then you don't owe her a dime.

If you mean by "she relinquished her rights to the house" to mean she waived her equity in the asset, then she deserves no part of the proceeds. If you ahve yet to remove her name from the Deed then you need to do that before you sell the house. As long as she is a titled land owner she has control over the sale and proceeds.

Good luck
