Kidnapping? No, not likely, but if there's a valid court order in effect which requires that you obtain your wife's consent for such a trip,

then you might find yourself the subject of a Rule to Show Cause as to why you should not be held in contempt of court(and appropriately sanctioned)if you take the child down south without first obtaining her consent.
