Legal Question in Family Law in Virginia

Too Late to Contest?

My husband filed for divorce and because I didn't have an attorney, I didn't contest it. We will be legally divorced next month, and I am not happy with the terms that he set forth in the paperwork given to me. Is it too late to contest the divorce and file on my own grounds? We haven't been to court for any of it. I was just served with the paper work and know that it is on file with the court house. By the terms of the agreement we will be legally divorced next month. My soon-to-be ex is telling me that I have waited too long, and that he doesn't even need my signature for us to be divorced. I find this hard to believe, being that we still have unsold martial property including a house and some land. However, our divorce papers state that we will have to split our martial property and that it will be taken care of seperately from our divorce. I am so confused!! Plus is our paperwork null and void if we had sexual relations months after the paperwork was filed?

Re: Too Late to Contest?

It may or may not be too late to contest the divorce itself, but it is likely not to late to contest many of the important terms. Unfortunately, at this point, the only way to be sure is to contact an attorney to advise you.
