Legal Question in Family Law in Virginia

Can my lawyer sopeana my husbands medical records?

Me and my husband are about to go to court for custody of our 2 children. He has been in and out of mental institutions for years. And now the other day passed out and hit his head. He woke up not knowing what date it was or where he was. Totally confused. He is in the hospital. They do not know what caused this yet. Can my lawyer sopeana his medical records for court?? I am scared this may happen again and he won't know my children. And when he passed out he was out for a long time. What can I do?

Yes, if the medical records bear on the issue

of what's in the best interests of the subject children (which would appear to be the case), they should be admissible as relevant evidence in the pending custody hearing.
