Legal Question in Family Law in Virginia

Leave the state

I have not told my husband but would like to know my options when I tell him I want to be separated and take the kids to my father's house to live for a while... we live in Virginia and my father is in Illinois. Can he charge me with kidnapping or some other extreme and force me to return?

No, as long as there is no valid court order currently in effect which would prohibit such action on your part.
