Legal Question in Family Law in Virginia

Need to leave state w/ kids

Due to emotional and sexual abuse directed at me, I feel I need to leave (and then divorce) my husband of nearly 13 years. I wish to take our 3 kids (12yrs, 8yrs 1yr)and move to Idaho to be with my family and support system. I expect him to refuse me to leave with the children so is sneaking out an option? What steps would I need to start in order to assure the safety of myself as well as my children?

Re: Need to leave state w/ kids

Unless there's now a custody/visitation order in effect which requires you to give the court as well as your husband 30 days advance notice of your intent to depart the Commonwealth with your three children, you can leave at any time----by

"sneaking" or in any forthright posture that you may choose.
