Legal Question in Family Law in Virginia

I would like to leave the state with my 8 year old son i live in the state of Va were he was born but I would like to relocte to FL were i was born in rasie. his father has to serve a 12 month 2 month sentence and has to go before a grand jury for two counts of malicous wounding. what are my changes of being able to leave with my son?

He was also convited with contributing to delinquency of a minor.and was to take parenting class but never did and has a probation violation for and has to go back to crout for that. what should i do?

You and your son can leave any time unless there's currently a valid court

order in effect forbidding you to make such a move or one that requires that

you first provide at least 30 days advance notice of your intended move to

the court and to the incarcerated father.
