Legal Question in Family Law in Virginia

left the marital home with child

I have left my husband and have taken our toddler son. We have drafted separation papers but he has asked for two more weeks to review them. That will put us at a month of being separated. Is this a tactic of some sort to sue me for support or kidnapping our son ? He knows where I am and has access to our son. The house is in my name but I am allowing him and my step daughter to stay because he has no where to go and I have family here. I just do not want any surprise lawsuits.

No, I don't see as likely any "surprise lawsuits" filed by your husband under these facts and for the reasons which you've suggested.
