Legal Question in Family Law in Virginia
legal seperation
I was married for 17 years and I worked and contributed financially after I had a stroke, and heart attack my husband decided to leave me sick and with 2 small kids I believe that I was shortchanged in our seperation. My husband led me to believe he could only afford to give me and the kids 1800 dollars to live on I just found out that he actually makes 200,000 a year how can I GET THE AGREEMENT THROWN OUT and get a more equitable settlenent/

Re: legal seperation
If your husband withheld or failed to disclose important financial information in the PSA(Property Settlement Agreement)which appears to have had a substantial effect on the
amounts of child and spousal support which you then agreed to, the entire agreement is likely suspect and probably needs to be voided and the whole process of settling the major issues of your dissolving marriage started anew. A lawyer might characterize it as fraud in the inducement(among other things).
Given what's already apparently happened with respect to this agreement, it would appear highly advisable for you to have a lawyer representing you in this matter, if you do not already have one.
Re: legal seperation
If your exhusband withheld important financial information, or otherwise committed fraud you may be entitled to some relief. However, given that your rights depend upon the separation agreement, the order, and the facts I would advise you to contact an attorney to review your case.
